Santa Ana To Formally Apologize For Burning Down Its Chinatown In 1906, Past Anti-Chinese Racism

Within days, a small white tent stood alone near the washed out ashes of Santa Ana’s Chinatown in 1906 with a cautionary sign: “leprosy: keep out.”

The day before the fire, his documented case of the disease, which was later disputed, prompted an emergency meeting of the Santa Ana City Council on the morning of May 25, 1906. Acting on a resolution drafted by the city’s Board of Health, council members unanimously moved to condemn Chinatown’s remaining buildings and directed the fire marshal to burn it all to the ground.

As word spread, more than 1,000 residents gathered in downtown later that night to watch the fiery finale of a years-long campaign against Santa Ana’s Chinese residents in the wake of the Chinese Exclusion Act of 1882. The Los Angeles Times deemed the blaze “as picturesque an event as could be imagined.”

But now, more than a century later, it’s seen as a shameful chapter in the city’s history — one that Santa Ana’s current council is moving to officially apologize for.

“We just want to do what’s right and recognize past wrongs,” said Thai Viet Phan, Santa Ana’s first ever Vietnamese American councilwoman. “I felt it was really important to me as someone who is trying to do my best to revitalize our Asian American heritage in the city.”

In a joint effort, Councilman Johnathan Ryan Hernandez, Planning Commissioner Alan Woo, Assistant City Manager Steven Mendoza and Councilwoman Phan worked on the draft apology.

It offers a formal atonement to “all Chinese immigrants and their descendants who came to Santa Ana and were the victims of systemic and institutional racism, xenophobia and discrimination.”

The resolution is also unequivocal in naming the past city officials responsible as well as deeming the burning of Chinatown as an act of “fundamental injustice, terror, cruelty and brutality.”

It served as the culmination of an effort to rid the area of Chinese residents that intensified when the city bought a lot in 1904 that abutted the enclave as the site of a new city hall.

By 1910, only one Chinese resident remained in Santa Ana according to census records; about 200 Chinese residents had once called Chinatown home during its peak in the 1890s.

Fred Lau, the late proprietor of Santa Ana Food Market, was one of the first Chinese Americans to return to Santa Ana during the 1940s. He opened his grocery store in 1949.

“The Lau family gave a lot of us our first jobs in Santa Ana when we were teenagers,” Hernandez said. “They had close relationships with my family.”

Santa Ana Food Market, which is still in business today, is where the councilman recalled first learning of the burning down of Chinatown from its owners.

With that history in mind, Hernandez began working with Woo, his Planning Commission appointee, on ways to redress the injustice when Phan had received an email earlier this year from a resident about recent Chinatown arson apologies elsewhere, including San Jose.

Woo felt a Santa Ana apology as timely as ever.

“There’s a wave of anti-Chinese and anti-Asian hate that has been fueled over the last two years,” he said. “It was important to ask for this, not just for me, but on behalf of the Chinese community because often we’re not viewed as citizens. We are treated as foreigners rather than citizens.”

An annual report by the Orange County Human Relations Commission charted a dramatic 1,800% increase in anti-Asian American hate incidents in 2020, which was the first year of the coronavirus pandemic.

In addition to the apology, there have also been efforts to commemorate the history with an on-site memorial.

During an October 2020 Downtown Inc. board meeting, a consultant briefly mentioned how an architect and urban planner were working with local historian Dylan Almendral and Chinese American groups on such a project.

“It was certainly a step in the right direction,” Hernandez said.

Taking the lead, supportive council members want to allocate funding from the city’s budget for a future memorial.

But the apology is slated to come first.

During the Santa Ana City Council meeting on May 3, council members directed staff to prepare the resolution to come back before a vote — and soon.

Phan insisted that the vote happen in May, which is Asian American and Pacific Islander Heritage Month; earlier in the meeting, both she and Hernandez presented a proclamation to the Lau family in recognition of the month.

The councilwoman also suggested that, if passed, there be a ceremonial signing of the resolution at the parking lot on Third and Bush Street, the site where Chinatown once stood.

Councilman David Peñaloza offered support for the apology and a ceremonial signing.

“It’s a sad, sad chapter in this city’s history,” he said. “We need to recognize the mistake that was made by previous leadership here.”

The burning down of Chinatown wasn’t the last time disease provided cover for discrimination in Santa Ana.

Dr. John I. Clark, the city’s health officer, had inspected the enclave and later cautioned residents from buying produce there out of concerns for leprosy; he would also advise the Santa Ana Board of Education to segregate white and Mexican students during the 1918 pandemic.

Less than two weeks after the Chinatown blaze, Ye was found dead inside his quarantine tent.

Before that, Councilman John Cubbon resigned from his post on May 28, 1906. The Times reported that he voted to authorize the burning down of Chinatown only after “considerable wrangling” and though there wasn’t an official explanation given, “reliable sources” placed that decision as the reason for his sudden resignation.

For Woo, the current council’s discussion this week marked a significant step toward making amends long overdue.

“The people’s democracy was used against Chinese Americans,” he said. “That deserves an apology. The lives of over 200 Chinese immigrants were affected by that decision.”

“One day I dreamed of it, I worked for it and today it’s a dream come true. I can finally tell you my big secret,” Jirau wrote. “I am Victoria’s Secret’s first model with Down syndrome!”

Panda Express Workers Forced To Strip In ‘Cult-Like’ Team-Building Seminar; 23-Year-Old Woman Sues For Sexual Battery, Hostile Work Environment, And Intentional Infliction Of Emotional Distress

A former employee of a Panda Express in Santa Clarita alleges she was required to strip down to her underwear and hug a partially clad co-worker during a “cult-like ritual” at a 2019 training seminar sponsored by the company as a prerequisite to promotion.

The 23-year-old woman is suing Panda Restaurant Group, headquartered in Rosemead, and Alive Seminars and Coaching Academy in Pico Rivera for sexual battery, a hostile work environment and intentional infliction of emotional distress.

She is seeking unspecified damages in the lawsuit filed last month in Los Angeles County Superior Court.

Although the woman is named in court documents, the Southern California News Group does not identify suspected victims of  sexual assault.

‘Horrific psychological abuse’

“We are looking forward to presenting this case to a jury so that a clear message can be sent to Panda Express — which owns and operates over 2,000 restaurants — that it must put to an end to its practice of requiring its employees to undergo horrific psychological abuse and harassment to be promoted,” Oscar Ramirez, the woman’s attorney, said in an email Monday.

Officials with Panda Restaurant Group said the company takes the woman’s allegations seriously and has conducted an investigation.

“Alive Seminars and Coaching Academy is a third-party organization in which Panda has no ownership interest and over which it exercises no control,” says a statement from the company. “While we always encourage personal growth and development, Panda Restaurant Group has not and does not mandate that any associate participate in Alive Seminars and Coaching Academy nor is it a requirement to earn promotions.

“We are committed to providing a safe environment for all associates and stand behind our core values to treat each person with respect,” the company said. “We do not condone the kind of behavior (the plaintiff) has alleged took place at Alive Seminars and Coaching Academy, and we would not intentionally allow it to occur within or on behalf of our organization.”

In an emailed statement, Alive Seminars said its training sessions are presented with respect and dignity.

The victim says she began working for Panda Express in 2016 and was told in July 2019 by then store manager Matthiu Simuda she needed to complete a self-improvement seminar conducted by Alive Seminars.

“Eager to improve her skills and advance within the company, plaintiff signed up and paid out of pocket to attend a four-day program,” the lawsuit says. “Panda Express pushed its employees in the Los Angeles region to complete Alive Seminars training. In many cases, it was a prerequisite to promotion.”

The seminar was held in a warehouse in East Los Angeles and attended by 20 to 50 Panda Express employees from throughout Southern California, Ramirez said. Those who attended the seminar were required to provide their employee identification numbers and received intake materials with the Panda logo.

“Alive Seminars served — in essence — as an extension of Panda Express’ own Human Resources department,” says the lawsuit.

Participants isolated, treated as ‘terrorists’

The complaint alleges the seminar was bizarre and quickly devolved into psychological abuse.

At the start, attendees were told to sit down and not talk, and were left in isolation for a full hour before a man stormed in, yelling in Spanish and berating them for sitting there and doing nothing, when that is exactly what they had been instructed to do, says the complaint.

The man, an Alive Seminars employee, loudly proclaimed that the attendees were “nothing” and “don’t matter,” and berated them individually, the suit says. “The overall effect was that of a particularly nasty drill sergeant.”

Seminar participants were prohibited from using their cellphones, there was no clock in the room and the doors and windows were all covered with black cloth.

“The atmosphere resembled less a self-improvement seminar than a site for off the-books interrogation of terrorist suspects,” the complaint alleges. “The sensory isolation and intimidation was reinforced by constant yelling and verbal abuse by seminar staff, creating an atmosphere of fear in the room. Nevertheless, most attendees, including plaintiff, felt that they had no choice but to remain because they were sent to the seminar by Panda Express and told that their opportunity for promotion would depend on completion of the seminar.”

Participants required to strip

When the seminar continued on July 13, 2019, the woman allegedly was forced to strip down to her underwear under the guise of trust building.

“Plaintiff — stripped almost naked in front of strangers and co-workers — was extremely uncomfortable but pressed on because she knew it was her only chance at a promotion,” says the lawsuit. “Meanwhile, Alive Seminars staff were openly ogling the women in their state of undress, smiling, and laughing.”

The exercise culminated when the victims and other participants had to stand up to yell about their inner struggles until everyone else in the group believed them.

“The last male participant had some difficulty ‘convincing’ the others and, as a result, broke down in tears,” the suit says. “Plaintiff was told to stand up and go to the middle of the room with the male participant, where they were forced to ‘hug it out,’ wearing nothing but their underwear. Plaintiff was humiliated but did as she was told.”

Seminar resembled cult ritual

As time went on, the seminar more and more resembled a cult ritual, the complaint alleges.

“Alive Seminars staff proceeded to dim the lights,” says the suit. “Plaintiff and the other attendees were instructed to stand up and close their eyes, pretending that a light from above would come down and take all the ‘negative energy’ out of them, then pretend that a hole opened up in the ground and swallowed the ‘negative energy.’ While this was happening, one of the Alive Seminars staff had a cell phone with the light on, recording plaintiff in her state of undress.”

Attendees, the lawsuit alleges, were confined in an atmosphere of fear and intimidation.

“If plaintiff wanted to use the restroom, someone from the Alive Seminars staff would stand outside the restroom door,” says the suit. “When another participant ran into the restroom to throw up, Alive Seminars staff ran after her. Another male participant was only given a small trash can to throw up in and was forced to do it in front of all the other attendees.”

During the July 13 session, the victim made an excuse of a family emergency and left the seminar.

The victim went to the seminar hopeful and optimistic about her future with Panda Express but left three days later “scarred and downtrodden.” Soon after, she quit her job because of emotional distress.

The suit alleges Panda Express “did not care about plaintiff’s experience at Alive Seminars or that she had been humiliated in front of her co-workers. Her chances of promotion were destroyed. plaintiff’s working conditions had become intolerable and Panda Express had no interest in addressing the situation.”

As France Entered A Second Lockdown, A Call To Attack Every Chinese Person On The Street Gained Momentum On Twitter; Garnering A Thousand Likes And Getting Shared In Equal Numbers

An angry, hate-filled Twitter call to attack Chinese people in the streets of France after the country went into a second COVID lockdown has been followed by a dozen assaults on Asians and fuelled the flames of anti-Asian sentiment.

The first time anti-Asian racism surfaced in France at the start of the pandemic earlier this year, it was characterised as xenophobia. 

It was a fear and distrust of the “other,” with people of East Asian descent lumped together as presumed carriers of the coronavirus that had started in Wuhan, China, says Sun-Lay Tan, spokesperson for Safety for All, a collective of 46 Franco-Asian associations in France. 

This time, it’s taken a much darker and angrier tone. “It’s no longer just xenophobia. It’s hate,” he said.

Immediately following President Emmanuel Macron’s televised address to the nation at the end of October announcing a second lockdown across the country, a Twitter call to attack every Chinese person on the street began gaining momentum, garnering about a thousand likes and getting shared in equal numbers. 

Replies to the original tweet, which has since been flagged and taken down, were also laced with violence and venom: 

“Hitler should have killed all the Chinese, not the Jews.”

“Put me in a cage with a Chinese I’ll have fun with them. I want to watch all their hope fade from their eyes.”

“It’s a hunt for Asians, for slanted eyes and yellow dog-eaters.”

“You’re only good for bringing back disease.”

What concerns Tan and other anti-racism activists is that these Twitter calls have gone offline and manifested in brutal attacks on Asians of all backgrounds in Paris. The day after the tweet was posted, a male Asian student was assaulted in an unprovoked attack while playing table tennis in the park with a friend (permanent ping pong tables are fixtures in some Parisian parks). According to Le Parisien, his attackers shouted “dirty Chinese” while assaulting him with pepper spray.

Asians are no stranger to being singled out by thieves and pickpockets in the Paris region as it’s mistakenly believed that they carry bundles of cash and are easy targets. But the most recent spate of attacks are driven by something more sinister, Tan said. “Previously, Asians were targeted for their money and were victims of robberies and muggings. Now, it’s not even money. It’s just out of hate.”

In another incident, a 37-year-old Asian woman identified as Françoise was attacked by a young couple who followed her off the city bus. Prior to the attack, a few words were exchanged about the young woman’s coughing fit and mask. The couple got off at the same bus stop as Françoise and attacked, pulling her hair, spitting and punching her in the face, yelling, “It’s because of you, you ch**k that we have coronavirus” and “Go back to China and eat dog,” reports Le Parisien.

“There’s been a crescendo of hate since the second lockdown, and a call to violence that we didn’t see before,” said Laetitia Chhiv, president of the Association of Chinese Youth of France. 

Along with the coronavirus, the collapse of Asian businesses in Chinatown, and the threat of another terror attack – France is on its highest terror alert following the beheading of high school teacher Samuel Paty and an attack in Nice that killed three people – Asians in France now have to worry about being targeted in hate-related assaults. 

“Safety has become their number one preoccupation lately,” Tan said.

Along with fear and anxiety, there’s a feeling of anger and disbelief at the misplaced hate, added Chhiv.

“They don’t understand why there’s so much hate. We are not responsible for the coronavirus and yet we’re insulted, assaulted and held responsible.”

Since the spike in assaults, Tan and Chhiv have launched a joint campaign through their groups warning Asians to be vigilant of their surroundings and to file a police report in the event of an attack. Because more often than not, Asian victims – particularly immigrants and the elderly – are less likely to go to the police, for reasons ranging from language barriers to shame, or lack of faith in the judicial system.

But it’s hoped a recent legal victory will change that. On the 12th of November, the French courts sentenced a trio of men two to seven years in prison for targeting, violently assaulting and robbing exclusively Asian women – believed to be easy targets – in the Paris region in 2019. Of the 28 victims identified, only six took part in the legal proceedings. But it’s a major victory that Chhiv hopes will encourage the community to trust the legal system. 

Meanwhile, the Paris prosecutor’s office has launched a formal investigation into the original Twitter call to attack Chinese “for inciting public provocation to carry out a physical attack of a racist nature.”

“We want to send the message that no, you can’t say whatever you want on social media and call for attacks on an entire population for no reason,” Chhiv said.

She also points out that social media played a big role as a vehicle for hate in both the assassination of Paty and the anti-Asian discrimination currently playing out across France. During a lesson on free speech, Paty showed his class a cover from the satirical magazine Charlie Hebdo, which depicted a cartoon of the Prophet Muhammad naked on all fours. One outraged Muslim parent waged a social media campaign against the teacher, which caught the attention of the killer who had no prior connection to the school or teacher.

“Social media can be a conduit for hate,” Chhiv said. “The fury on social media is nefarious for society. All it takes is for one person with bad intentions to stumble on a hateful post and use it to justify their violent behaviour.”
